Boatsale Terms of Service

NJ Boats and Boating offers "Boatsale" advertising services for boat owners, dealers, brokers and others interested in selling a boat. This page describes the terms of those services and is a supplement to the general Website Terms of Service available separately on NJBoatsAndBoating.com.

The following sections describe the terms of service, and are intended to make it easier to find what you need - with the usual disclaimer that our efforts to organize these terms does not invalidate a provision if you do not find something where you expected to find it. All terms always apply. So here are the categories, which you can click to be taken to the body of each category further down the page.

Participants

NJ Boats and Boating (NJBB) participates only to offer an advertising service and is not a principal in any advertisement displayed, and is not the boat owner, seller, broker or in any other directly related position relative to any boat advertised. As such, NJBB has no specific knowledge of any boats advertised for sale and does not review or warrant the content of any advertisement for accuracy. All buyers should engage the services of a professional Marine Surveyor and an Attorney before purchasing any vessel.
Boat owners, sellers, brokers, dealers etc., (herein "Sellers"), may purchase advertising services as provided by NJBB under the terms and prices offered at any specific time.
Prospective buyers may review the boats listed for sale and contact the sellers through the online services offered.

Communication

NJBB may be contacted using the general website Contact Form. Sellers will be contacted through their website registration at the email address on their registration. Sellers should maintain this email account in an active state and check it regularly. Potential buyers have no requirement to have an email address on file and must provide an email address or other contact information when contacting a seller. Buyer's are encouraged to register as a member on the website, although this information may not be recorded on boatsale buyer activity.

General Guidelines

All participants, buyers and sellers, are required to adhere to the General Website Terms of Service for acceptable behavior. Unacceptable boatsale activities include, any actions to interfere with the website operation, user listings, database operations or communications, or the sending of any fraudulant or malicious messages, or in any other way abusing any user information including user names, email addresses or other information.
All advertised boats for sale must represent actual, specific boats and actual sales intent by authorized sellers or their representatives, brokers etc. No listing may be fraudulant or otherwise illegal. New boat models may be advertised by authorized dealers where the objective is a new boat order rather than the sale of a specific boat.

Boats

Any boat advertised for sale must be manufactured by one of the builders featured on this site. Specific models should be identified and indicated by selecting from the selection list available during posting. All photos included with a boat listing must be photos of the specific boat being offered for sale, except in the case of new boat advertisements. Photos from the website pages may NOT be used and are the copyright material of the website owners.

Listings

Registered Users at NJBoatsAndBoating.com may list a boat for sale, unless individually restricted for any reason by NJBB. A listing may be for a single boat, which may not be changed. The listor may modify his listing at any time, retaining the same boat and subject to certain items which may be restricted to changes. Listings remain with the original listing registered member and may not be transferred. Listings are available subject to payment for listing fees and may be deactivated by NJBB upon expiration of the listing term and payment.

Listing Payments

Payment for listings is required in advance according to the payment rates and terms offered at the time of payment. New listings will be activated, either automatically or manually, as soon as possible following payment, and depending on the form of payment. Renewals are available only at the terms offered at the time of renewal. Upon expiration of a paid listing term, NJBB may deactivate the listing making it unavailable to potential buyers. NJBB, at its option, may leave an expired listing active, in which case any renewal by the listor will be calculated from the expiration date, or pro-rated for the days the listing was active and unpaid.
Listors may terminate a listing, as in the case of a successful sale. There is no partial refund for terminated listings. Listors may temporarily deactivate a listing for up to 90 days, once within a 365 day year, and receive an adjustment in the expiration date.

Warranties of Service

While NJBB makes every effort to provide excellent service, including hosting the website on a professional service, and making periodic backups, it can not guarantee uninterrupted service, expected search results, successful email contact or error-free storage of listing descriptions and photos, nor the ability to restore all user data in all situations. Listors should take action to minimize risks, including maintaining email accounts and site registration information, retaining original photo files, keeping a printed copy of each listing, and checkings listings periodically. NJBB shall not be required to make adjustments or provide refunds due to service not being provided as planned and expected. NJBB's sole obligation shall be to allow the Seller to repost any listing for the remainder of the paid listing time.
